1. Acceptance of Terms
By accessing or using the Migido mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service
Migido is a club management platform that allows users to create and manage sports clubs, track members, handle payments, and access analytics. The App is available in two tiers:
- Free Plan: Core features including club creation, member management (up to 30 members per club), payment tracking, and push notifications.
- Premium Plan: All free features plus unlimited members, data export (Excel), advanced analytics, and priority support.
3. Account Registration
To use Migido, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
4. Subscription and Payments
Premium subscriptions are available on a monthly or yearly basis. All payments are processed securely by Paddle.com, our Merchant of Record. By subscribing to a premium plan, you agree to the following:
- Billing: You will be billed at the start of each billing cycle (monthly or annually) at the rate displayed at the time of purchase.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
- Currency: Prices are displayed in Moroccan Dirham (MAD). Paddle may convert currencies based on your payment method and location.
- Payment Methods: Accepted payment methods are determined by Paddle and may include credit/debit cards and other local payment methods.
- Taxes: Paddle handles all applicable taxes as the Merchant of Record. The displayed price may be exclusive or inclusive of taxes depending on your location.
5. Cancellation
You may cancel your premium subscription at any time through the App's subscription management screen. Upon cancellation:
- Your premium features will remain active until the end of the current billing period.
- After the billing period ends, your account will revert to the Free Plan.
- No partial refunds are provided for unused time within a billing period.
- Your data will be preserved, but features restricted to premium users will become inaccessible.
6. Free Plan Limitations
The Free Plan is subject to the following limitations:
- A maximum of 30 members per club
- No access to data export features (Excel)
- No access to advanced analytics (revenue analytics, member trends)
These limits may be adjusted at our discretion with reasonable notice.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to any part of the App or its systems
- Interfere with or disrupt the App's infrastructure
- Upload malicious content, viruses, or harmful code
- Impersonate another person or entity
- Use the App to send spam or unsolicited communications
- Reverse-engineer, decompile, or disassemble any part of the App
8. Intellectual Property
The App, including its design, code, logos, and content, is the intellectual property of Migido and is protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.
You retain ownership of any data you input into the App (club information, member data, etc.).
9. Data and Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, Migido and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the App.
Our total liability for any claim arising from the use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We will make reasonable efforts to notify users of significant changes, particularly those affecting paid subscriptions.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms in the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
